Terms & Conditions

These Terms & Conditions govern the contractual relationship between Diamond Desert Travel CC (“we”, “our”, “us”) and the client (“you”) regarding the safari and travel services provided.

1. Scope of Services

1.1 We provide travel and safari services in Namibia, which can be customised according to the client’s preferences.

1.2 These Terms & Conditions apply to all bookings made with Diamond Desert Travel CC.

2. Booking and Contract

2.1 Bookings must be made in writing or electronically.

2.2 A booking constitutes an offer to enter into a contract.

2.3 The contract is confirmed only upon our written confirmation of your booking.

3. Prices and Payment

3.1 Prices are based on the agreed services and are provided to the client before the contract is confirmed.

3.2 A  non-refundable deposit of 25% is required to confirm the booking. The balance must be paid 60 days before the start of the tour.

3.3 Late payments may incur interest at 2% above the base rate.

3.4 In the case of bookings confirmed within 30 days of arrival, the total amount payable must be settled within 48 hours of confirmation.

3.5 All advertised rates are indicative only and remain subject to availability, seasonal adjustments, and exchange rate fluctuations at the time of confirmation.

3.6 SADC residents may qualify for special rates where applicable.

4. Cancellation and Rebooking

4.1 Cancellations or changes must be made in writing.

4.2 Cancellation fees:

  • More than 60 days before departure: 50% of the total tour price

  • Less than 60 days before departure: 100% of the total tour price

5. Liability

5.1 We are not liable for personal property damage, injuries, or losses incurred during the tour.

​

6. Travel Insurance

6.1 Clients are strongly advised to take out comprehensive travel insurance covering personal injury, medical costs, lost luggage, trip cancellations, and interruptions.

6.2 We are not liable for costs arising from insufficient or incomplete insurance coverage.

7. Health and Fitness

7.1 Clients must be medically fit to participate in the tour. We reserve the right to refuse participation if health or fitness is deemed insufficient.

7.2 Clients must disclose any pre-existing conditions, allergies, or dietary restrictions at the time of booking.

8. Passports, Visas, and Vaccinations

8.1 Clients are responsible for holding a valid passport, visa, and required vaccinations for travel to Namibia.

8.2 We are not liable for costs or delays due to non-compliance with entry, customs, or health requirements.

9. Itinerary Changes

9.1 We aim to follow the confirmed itinerary, but circumstances such as weather, road conditions, or unforeseen events may require changes.

9.2 Significant changes will be communicated promptly. Any additional costs resulting from changes are the client's responsibility.

10. Force Majeure

10.1 We are not liable for failure to fulfil obligations due to events beyond our control, including natural disasters, strikes, pandemics, war, or civil unrest.

10.2 We will make reasonable efforts to provide alternative arrangements or reschedule the tour. Any additional costs due to force majeure are borne by the client.

11. Client Conduct

11.1 Clients must behave respectfully and safely at all times. We reserve the right to terminate a tour without refund if client behaviour is deemed dangerous, disruptive, or offensive.

11.2 Clients must follow all safety guidelines and instructions given by our representatives.

12. Photography and Marketing

12.1 Photos and videos may be taken during the tour for marketing purposes. Participation implies consent for your image to be used.

12.2 Clients wishing not to be photographed or filmed must notify us in writing before the tour.

​

13. Complaints and Dispute Resolution

13.1 Complaints during the tour must be reported to our representative immediately.

13.2 Unresolved issues must be submitted in writing within 30 days after the tour.

14. Legal

14.1 Amendments to these Terms & Conditions must be in writing.

14.2 This contract is governed by the laws of the Republic of Namibia.

14.3 The place of fulfilment and exclusive jurisdiction for all disputes is Windhoek, Namibia.
